Vote on Local 79 Agreement

City Council has voted 21-17 to adopt the following:



That Council adopt the following recommendations contained in Item CC39.1, which relate to Local 79:

Recommendation 1
1. Ratify the attached four Memoranda of Agreement dated July 29, 2009, between the City of Toronto and the Canadian Union of Public Employees Local 79 contained in Confidential Attachment 3, to effect new three (3) year Collective Agreements between the parties for the period January 1, 2009 to December 31, 2011.

Recommendation 3, as it pertains to Local 79
3. Authorize staff to make the necessary amendments to rates of pay, benefits and other issues identified as agreed changes in the new Memoranda of Agreement and the new Memorandum of Settlement and any agreed retroactive provisions.

Recommendation 4, as it pertains to Local 79
4. Authorize staff to make the necessary adjustments to the 2009 Non-Program Expenditure Budget and Operating Budgets of the Divisions to reflect the provisions of the Memoranda of Agreement and the Memorandum of Settlement.

Recommendation 5, as it pertains to Local 79
5. Authorize the release of information as follows at the end of the meeting at which the Memoranda of Agreement and Memorandum of Settlement are ratified by Council and these recommendations are approved:

a. Memoranda of Agreement with CUPE Local 79 contained in Confidential Attachment 3 to be made public.
c. Section 2 of Confidential Attachment 1 regarding CUPE Local 79 headed “Summary of the Memoranda of Agreement” to be made public.
e. The balance of Confidential Attachment 1 to remain confidential as it contains information about labour relations and employee negotiations.

The motion did not carry, the required two-thirds vote not being achieved (23 yes, 13 no)

Vote to uphold the Speaker

The Speaker ruled that the return to work protocols were not before City Council at today's meeting. Challenged by Councillor Minnan-Wong, the Speaker was not upheld by a vote of 15-19.

Meeting called for August 5 & 6, 2009

The Mayor has called a meeting of City Council starting Wednesday, August 5 at 9:30 AM in the Council Chamber, Toronto City Hall.

This is in place of the meeting previously scheduled for July 6 & 7, 2009 that was cancelled due to the strike.

(Note: The Mayor initially called a meeting for August 5 & 6 to deal with urgent business, but now that a tentative agreement has been reached, the purpose has been changed to a full meeting of Council).

Vote on Item CC37.1 - Streetcar Funding

City Council has approved item CC37.1

1. City debt financing replace the one third federal funding budgeted for a total City debt funding amount of $834 million for the TTC Capital Project No. CTT122 “Purchase of 204 Light Rail Vehicles (LRVs)”.

2. In order to not increase the net debt for the City of Toronto’s 2009 to 2018 Capital Plan, Council authorize the reallocation of debt funding in the amount of $417 million from TTC capital projects that are to be deferred beyond 2018, as outlined in Appendix A of the attached communication from the Chief General Manager of the TTC.

3. Council authorize the City Manager and the Deputy City Manager and Chief Financial Officer to take the necessary actions to give effect thereto.

Special meeting of City Council - June 26, 2009

In accordance with §27-28 of Chapter 27 of the City of Toronto Municipal Code, the Mayor has called a special meeting of City Council on Friday, June 26, 2009 at the Metro Toronto Convention Centre, 255 Front Street West, Room 105, North Building, Toronto, Ontario, for the following purposes, such meeting to start at 10:00 a.m.:

1. to consider a report (June 25, 2009) from the City Manager and the Deputy City Manager and Chief Financial Officer, headed "Purchase of 204 Light Rail Vehicles (LRVs) - TTC Capital Funding".

2. to introduce and enact a confirming by-law for this special meeting.
