That City Council delete Recommendations 1 and 2 contained in the report (September 29, 2009) from the City Solicitor and adopt instead the following:

1. Council adopt Recommendation 1 contained in Confidential Attachment 1 to the report (September 29, 2009) from the City Solicitor.

2. Council direct that Confidential Attachment 1 remain confidential in its entirety, at this time, in accordance with the provisions of City of Toronto Act, 2006, as it contains information that is subject to litigation or potential litigation, affecting the municipality or local board and solicitor-client privilege. The confidential information contained in Confidential Attachment 1 may be made public at the discretion of the City Solicitor.

That:

1. the recommendations contained in the report (September 29, 2009) from the City Solicitor be deleted;.

2. Council accept the Settlement Offer dated September 10, 2009 subject to detailed Minutes of Settlement being prepared and executed to the satisfaction of the City Solicitor in consultation with the General Manager of Parks, Forestry and Recreation;

3. The Chief Planner be directed to undertake a Secondary Plan review of the lands bounded by *The Donways* as well as the lands designated Mixed Use Areas and Apartment Neighbourhoods adjacent to *The Donways, in consultation with representatives of the local
community, to consider such refinements to the Central Don Mills Secondary Plan as may be warranted to ensure that approval of the proposed redevelopment of the Don Mills Centre does not destabilize these adjacent land areas;

4. Community Planning be directed to survey medical practitioners and other medical service providers currently located at 75 The Donway and generally within the Don Mills Secondary Plan area to determine interest in re-location within the commercial space of the Don Mills Centre;

5. The Applicant be requested to continue its efforts to create tenancies for medical practitioners and medical service providers within the Don Mills Centre in consultation with the Ward Councillor;

6. The Applicant be requested to advise the Ward Councillor of its plan for providing publicly-viewable art in Phase II, in addition to that already provided in Phase I, and to implement that plan in consultation with the Ward Councillor;

7. The General Manager of Parks, Forestry and Recreation, in consultation with necessary City staff and the Ward Councillor, be directed to explore with the Applicant the potential for providing a combined community centre and twin-pad arena within the Don Mills Centre, and to report thereon to the North York Community Council.

8. Council direct that the Confidential Attachment to the report (September 29, 2009) from the City Solicitor remain confidential in its entirety in accordance with the provisions of the City of Toronto Act, 2006, as it contains information about litigation or potential litigation, including matters before administrative tribunals, affecting the municipality or local board and solicitor-client privilege.

1. City Council approve an amendment to the Umbrella Agreement to allow a deposit surety to be treated in the same manner as a CMHC insured construction lender under the terms of the Umbrella Agreement.

2. City Council approve that the unconditional closing date of August 14, 2009 now be revised to be a date which is no later than the fifth business day following the date of Council approval.

Motion to Amend Item (Additional) moved by Councillor Pam McConnell (Final)

That Council adopt the following recommendations contained in the report (September 29, 2009) from the Deputy City Manager [EX33.18c] with the 5th bullet in Recommendation 1 amended so that the Recommendations now read as follows:

1. The East Bayfront (EBF) Transit EA report and Environmental Study Report (ESR) provide for an additional traffic control signal at the centre driveway of 95 Queens Quay East, the Redpath Sugar Ltd. site, under the following conditions:

· the signal will operate under complete transit pre-emptive control;
· the signal will operate independent of, and not be coordinated with any of the adjacent or nearby traffic control signals;
· the intersection at this location will not provide north-south pedestrian crossing facilities;
· the signal will be removed if the sugar processing and storage plant at 95 Queens Quay East ceases to exist at this location; and
· the impact of the signal on transit operations will be formally assessed by TTC and Transportation Services staff, in consultation with Red Path Sugar, at five year intervals commencing in 2015 as East Bayfront and the Port Lands are developed, with mitigation measures, including the possible removal of the signal, being put in place as needed to ensure effective delivery of rapid transit service to these areas.

2. Any future proposals to install additional signals on Queens Quay East beyond those identified in Part 1 above and in the Queens Quay Revitalization and EBF Transit EA reports, between Parliament and Bathurst Streets, and which would result in vehicles and/or pedestrian crossings over the transit right-of-way, be supported by an independent technical audit completed to the satisfaction of the Deputy City Manager responsible for Transportation Services and Waterfront Revitalization and the Chief General Manager of the Toronto Transit Commission (TTC), to ensure that such signals can be installed in a manner that allows safe traffic operations and does not detrimentally impact light rail transit operations.

3. Consistent with the direction in the Queens Quay Revitalization EA report and to ensure the safety of all right-of-way users, detailed design of Queens Quay West will provide for:

(i) a physical separation between traffic lanes on Queens Quay West and the adjacent transit right-of-way; and

(ii) the retention of a traffic safety and operations consultant to provide expert advice during the design process, with such consultant being to the satisfaction of the Deputy City Manager responsible for Transportation Services and Waterfront Revitalization and the Chief General Manager of the TTC.

4. The Toronto Police Service be requested to review and report back to City Council on the feasibility of utilizing the Denver Boot as a means of enforcing parking restrictions for tour buses on Queens Quay;

5. The appropriate City officials be authorized and directed to take the necessary action to give effect thereto.

City Council request the Waterfront Project Director and the Chief Planner and Executive Director, City Planning, in consultation with Waterfront Toronto, the General Manager, Parks, Forestry and Recreation, and the Harbourfront Centre, to re-examine the current parks designation to determine the viability of broadening the land-use permissions for this property to included mixed-use permission and respond to waterfront parking needs in conjunction with the upcoming Environmental Assessment for a potential north-south road west of Rees Street.

i. the signal be limited to right turn (eastbound) egress only;

ii. the signal will operate under complete transit pre-emptive control;

iii. the signal will operate independent of, and not be coordinated with, any of the adjacent or nearby signals;

iv. the intersection at this location will not provide north-south pedestrian crossing facilities;

v. an alternative location for loading and drop-off for adjacent landowners and businesses be confirmed; and

vi. the proposed bus turning plaza be removed from the Environmental Assessment recommendations.
