Motion by Councillor Carroll on EX17.1

Councillor Shelley Carrol has made a motion amending a previous motion by Councillor Vaughan, as follows:

That:


1. City Council amend Executive Committee Recommendation 10.a. by adding the following words "or at values deemed to maximize the use of TCHC assets to meet Toronto's social and housing needs" so that the Recommendation now reads:


10. City Council request the Board of Directors of Toronto Community Housing Corporation to:


a. initiate a process to solicit interest for the purchase of the stand-alone properties listed in Appendix A of the report (January 10, 2012) from the City Manager and General Manager, Shelter, Support and Housing Administration, at market value or at values deemed to maximize the use of TCHC assets to meet Toronto's social and housing needs from social housing providers, charitable, non-profit and community agencies that deliver housing to low-income and vulnerable populations within Toronto;


2. City Council amend Executive Committee Recommendation 12.b. by adding the following new sections:


x. alternate tenure and management approaches for TCHC's stand-alone houses, drawing on practices in other jurisdictions.


xi. options for raising revenues or finding savings to bridge TCHC's annual capital shortfall.

That City Council amend Executive Committee Recommendation 1.a by replacing the word "in" with the words "with 50 percent to be allocated towards" and by adding the words "and with 50 percent to be allocated towards community renewal initiatives", so that Recommendation 1.a now reads as follows:
1.a. prior to the sale of any properties, TCH provide a plan, satisfactory to the General Manager, Shelter, Support and Housing Administration, and the Deputy City Manager and Chief Financial Officer, for the administration and use of the proceeds of any sales of stand-alone units, net of reasonable transaction costs with 50 percent to be allocated towards the state of good repair of existing social housing units, consistent with its Real Estate Investment Strategy – "Housing Works; and with 50 percent to be allocated towards community renewal initiatives.

Balloting Procedures for

Appointments to Committees and Boards

In accordance with Robert's Rule of Order





Nominations:

1. The Chair calls for nominations.



2. Members can nominate candidates including themselves, and nominations do not require seconding.



3. The Chair calls three times for further nominations, and if no further nominations are made, the Chair declares the nominations closed and announces the nominees.



4. Each candidate is permitted to address Council for up to 5 minutes, with no extension.



5. Members may question nominees provided that the total time for questioning, including answers, is not longer than ten minutes. (s. 27-136B, Council Procedures)



Voting:

1. A majority of ballots cast is required to elect a Member to an open position. (i.e., 23 votes if 45 ballots are cast).



2. The City Clerk will distribute ballots to the Members.



3. The City Clerk will display the names of the nominees in the order they were nominated.



4. Members will mark their ballots by printing the names of candidates.



5. Notwithstanding the nominations process, a voting Member may write-in any Member's name, even if they have not been nominated.



6. Members can vote for up to the number of open positions. If a Member votes for more than the maximum number, the ballot will be spoiled and no votes will be counted.



7. Members can vote for any qualified candidate. If a Member writes in the name of a person who is not qualified to fill the vacant position, the ballot will be spoiled and no votes will be counted.



8. Secret ballots are prohibited by law. Members must print and sign their names on all ballots. Unsigned ballots will be spoiled and no votes will be counted.



9. All ballots are public and will be recorded in the minutes of the meeting.



10. The City Clerk shall collect and count the ballots.



11. Members must remain seated until all ballots have been collected by the City Clerk.



12. The City Clerk announces the results and declares elected any nominees who receive a majority of votes cast.



13. If the number of candidates who receive a majority of votes is less than the number of open positions, a second ballot shall be conducted.



14. A second ballot shall be conducted for remaining vacant positions with all of the remaining candidates' names. No candidates are removed from consideration other than those that have already been elected.



15. Steps 13 and 14 are repeated until all positions are elected by a majority.



16. After the City Clerk announces the results of the final ballot, she announces the final list of Members that have been elected.



17. The appointments are final once announced, subject to the enactment of the necessary by-laws.

Motion by Councillor David Shiner on EX16.8

Councillor David Shiner has made the following motion on item EX16.8:

That the Executive Committee Recommendations be deleted and Council adopt the following instead:
 
1. Notwithstanding Part 12 of Executive Committee Item EX4.7 adopted by Council at its meeting on April 12 and 13, 2011, City Council approve the following new governance structure for the Toronto Transit Commission to take effect immediately:
 
a. a five (5) member Commission composed of Council members, including a Chair appointed by City Council;

 
b. a Vice Chair appointed by the Toronto Transit Commission from among the Council members appointed by City Council; and
 
c. Council members will serve for a 2-year term of office, at pleasure of City Council, or until successors are appointed.

2. City Council rescind the existing nine (9) Council member appointments to the Toronto Transit Commission, effective immediately.
 
3. City Council at this meeting appoint, by ballot:
 
a. five (5) Council members to the Toronto Transit Commission; and
 
b. a TTC Chair from among the five (5) Council members appointed to the Toronto Transit Commission
 
for a term of office effective immediately and until November 30, 2014, notwithstanding Part 1c above, or until successors are appointed.
 
4. City Council increase the composition of the Toronto Transit Commission from five (5) to eleven (11) effective with the October 30, 2012 City Council meeting, by adding four (4) citizen members appointed by City Council, one (1) citizen member nominated by the federal government and appointed by City Council, and one (1) citizen member nominated by the provincial government and appointed by City Council, subject to the following:
 
a. Citizen members, and federal and provincial citizen representatives will serve for a 4-year term of office, generally coinciding with the term of the Council that makes the appointments, at pleasure of City Council, or until successors are appointed; except in the initial term of office for citizen members and federal and provincial representatives, where the term will be for the balance of the 2010-2014 term of Council, or until successors are appointed;
 
b. Citizen members, and federal and provincial citizen representatives will serve a maximum of 2 consecutive 4-year terms to a limit of 8 years, or until successors are appointed; except for maximum service for initial citizen members, and federal and provincial representatives of one and a half consecutive terms of Council to a limit of 6 years, or until successors are appointed; and

 
c. The Toronto Transit Commission appoint a Vice Chair from among the four citizen members appointed by City Council.
 
5. City Council approve a rate of remuneration for citizen members of the Toronto Transit Commission of $10,000 per year, and $15,000 per year for the citizen Vice Chair of the Toronto Transit Commission.

 

 
6. City Council authorize the City Manager to commence recruitment as follows:

 
a. the 4 citizen members be recruited through an advertised recruitment process (Type 1 recruitment process as set out in the Public Appointments Policy) and the Civic Appointments Committee shortlist and interview candidates and then recommend the appointment of citizen members for approval by City Council.

 
b. the federal and provincial citizen representatives be recruited through the interest group nomination process.


 

 
7. In addition to the general eligibility requirements of the Public Appointments Policy, City Council approve qualifications for the citizen board members who shall have directorship and executive-level experience and collectively represent a range of skills, knowledge and experience with one or more large organizations in the following areas:

 
  • - Strategic business management, including transformative change management;
  • - Financial management, accounting, law, engineering;
  • - Customer service or marketing management;
  • - Management or planning with a rail or public transit organization;
  • - Formulation and/or management of public-private partnerships;
  • - Capital project/construction management or capital procurement/supply chain management;
  • - Operations and information technology; and
  • - Labour relations/industrial safety management.

 8. City Council request the Toronto Transit Commission to amend its Procedure By-law to be consistent with the governance changes recommended in this Item and forward the amended by-law to the City Manager for City Council approval in accordance with Council's policy requiring approval of board by-laws that regulate the internal conduct of the business and affairs of the board [Executive Committee Item EX4.6, Part 2a.i., adopted by City Council at its meeting on April 12 and 13, 2011].

 

 
9. City Council request the City Manager to amend the Public Appointments Policy and the Remuneration Policy to reflect the governance changes recommended in this Item.


 
10. City Council request the City Manager to develop the role and responsibilities:

 
a. for the position of Chair; and

  b. for the position of Vice Chair, to be considered by the Civic Appointments Committee in its consideration of candidates.

  11. City Council authorize the City Solicitor to introduce the necessary Bills in Council to amend Chapter 279, Toronto Transit Commission, of the Toronto Municipal Code, and to give effect to the appointments to the Toronto Transit Commission.
